What CROA Requires of Credit Repair Companies

1. No Upfront Fees

This is the most important rule. Credit repair companies cannot charge you before they've performed services. They must complete work first, then bill you. Any company that demands full payment upfront before doing anything is violating federal law.

Note: The payment structure can vary — some charge monthly, some charge per item removed, some charge per dispute round. What matters is that they can't take money before services are rendered.

2. Written Contract Required

Before any services begin, the company must provide a written contract that includes:

  • A detailed description of the services to be performed
  • The total cost of services
  • A guarantee of performance timeline
  • The company's name and business address
  • A statement of your right to cancel within 3 business days

3. Three-Day Cancellation Right

You have the right to cancel the contract within 3 business days of signing without any charge. The company must clearly disclose this right.

4. No False Claims

Credit repair companies cannot:

  • Guarantee specific score increases
  • Promise to remove accurate, verified information
  • Claim they can create a "new credit identity" (file segregation — a federal crime)
  • Advise you to misrepresent your identity or credit history
  • Make misleading statements about their services

5. Consumer Rights Disclosure

Before signing a contract, the company must provide a written disclosure statement informing you that:

  • You have the right to dispute inaccurate information yourself for free
  • You can obtain your credit reports directly from the bureaus
  • You have the right to cancel within 3 days
